1. Acceptance
XIMO (ximo.tv, mobile web, and the iOS app, the “Service” or “Website”) is provided by the XIMO operator. By accessing the Website, agreeing, signing in, registering, or using the Service, you accept these Terms of Use, the Privacy Policy, the Cookie Notice, the Rules, and the CSAM Policy (together, the “Terms”). If you do not agree, do not access or use the Website or any service on it.
2. Age and minors
The Service includes adult short dramas and is available only to people who are at least 18 years old, or 21 years old where 21 is the age of majority. People under that age must not access or use the Service, including with a parent or guardian present. You must confirm your age truthfully. We do not knowingly serve minors. We may suspend or delete an underage account without restoring consumed virtual items. You must not show restricted content to minors or help them access it.
3. Accounts and passwords
You may create an account with Apple, Google, or email. Membership is not transferable. Information you provide must be accurate and kept up to date. You must keep your password safe and must not share it. You are responsible for activity under your account. Report suspected unauthorized use to [email protected] immediately. We will never ask for your password. You may request deletion in the app under Feedback, or by emailing [email protected]. After identity verification we typically complete deletion within 15 days. Deletion may remove profile data, history, unused xi coins, and entitlements, except where law requires retention.
4. License and prohibited use
We grant you a personal, non-transferable, non-exclusive, revocable license to watch and buy content under these Terms. You may not reverse engineer, scrape, monitor, or copy the Website with bots or spiders; bypass payment, region, or age limits; distribute malware; overload the service; tamper with content; resell access; or require or incentivize anyone to click or watch ads, including by paying them or giving them virtual items for doing so. You may not post unlawful, fraudulent, misleading, defamatory, hateful, discriminatory, or violent content, spam, or content that infringes intellectual property, likeness, or privacy rights. Series, covers, previews, and landing pages must also follow the content prohibitions in the Rules.
5. User content and synthetic performers
Comments, profile materials, and series you submit must be lawful, and you must have the rights to publish them. You warrant that you are authorized to publish the content, that it does not infringe any person, and that you have the permissions needed to display it, including consent to use a person’s likeness and any apparent likeness in artificially generated or manipulated content. Every series, cover, and preview on the Service is AI-generated or synthetic and is labeled “AI Generated” on the cover and in the player. Where law requires a disclosure of synthetic performers, the creator must make that disclosure clear. You grant us a worldwide, royalty-free, sublicensable license to host, display, moderate, transcode, and distribute user content to operate the Service. We may preserve and disclose content to comply with law, enforce these Terms, respond to complaints, or protect users and the public.
6. Virtual items and payments
xi coins are virtual items usable only inside the Service. They have no cash value and are not transferable. iOS purchases are processed by Apple under the Apple Media Services Terms; refunds are handled by Apple. Website deposits, including Alipay, card, and USDT, also become xi coins and are subject to the terms, fees, and chargeback rules of the payment gateway and card provider you use. Except where required by law or the channel’s policy, consumed coins used for unlocks, subscriptions, or tips are non-refundable. You are responsible for income and similar taxes arising from your own use of the Service.
7. Unlocks, subscriptions, and tips
An unlock typically grants ongoing viewing of a title while your account remains valid, subject to takedowns. A takedown for copyright, illegality, or force majeure is not by itself a full refund. A creator subscription lasts for the stated term. Tips are voluntary and final.
8. Moderation and reporting
You are responsible for what you post. We do not undertake to pre-screen all content, but we may monitor, edit, restrict, or remove content that we consider unlawful, infringing, defamatory, invasive of privacy, or otherwise inappropriate. Report content that you believe violates law, third-party rights, or these Terms to [email protected]. We may warn the user, remove or restrict content, suspend or terminate an account or monetization, and refer matters to law enforcement. We consider the nature and severity of the content and the information supplied with the notice. We do not tell the uploader who reported the content unless that is necessary to explain a decision, such as an intellectual-property claim. CSAM reports may be made anonymously. See the CSAM Policy. We may suspend access to reporting tools if someone repeatedly sends notices that are manifestly unfounded.
9. Intellectual property
The software, marks, interface, and catalog (other than your user content) belong to XIMO or its licensors. Do not redistribute paid video. You may not reproduce or commercially exploit the Website without our prior written consent. If you believe your rights are infringed, contact us through the copyright page or [email protected] with proof of rights, the location of the material, and your contact details. We do not investigate ownership of every work.
10. Third parties, ads, and links
The Service may link to third-party websites or show advertising from partners. We do not control those sites or ads and make no warranty about their content, goods, fitness, or non-infringement. Where we do not have actual knowledge that third-party content is illegal or infringing, we are not liable for your use of it. Third-party destinations have their own terms.
11. Cookies
The Website uses cookies and similar technologies for sign-in, security, language, and invite attribution, and, if you allow them, for functional and advertising purposes. Essential cookies cannot be switched off. You can accept all, keep essential cookies only, or set functional, analytics, and targeting cookies separately in the cookie prompt or at https://ximo.tv/cookies. Third-party advertising partners, including ad networks and their advertisers, may place cookies on your browser when you allow targeting cookies. See the Privacy Policy and Cookie Notice.
12. Disclaimer and availability
The Service is provided “as is” and “as available.” We do not warrant that it will be uninterrupted, error-free, virus-free, fit for your requirements, or compatible with your devices. Maintenance, upgrades, legal duties, or events beyond our control may limit access, including in particular regions. Force majeure includes labor disturbances, internet outages, supplier failures, fire, natural disasters, war, and terrorism. We do not guarantee user identity, third-party content, or transaction results. Adult content may be disturbing; you watch it voluntarily and at your own risk. To the fullest extent permitted by law we exclude warranties of quality, safety, title, merchantability, and fitness for a particular purpose. Where a warranty cannot be excluded, our liability is limited to resupplying the service or crediting its cost.
13. Liability and indemnity
To the fullest extent permitted by law, we and our affiliates, directors, employees, and agents are not liable for indirect, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or personal injury, even if advised of the possibility. Limits that a jurisdiction does not allow do not apply there. You will indemnify and hold harmless XIMO and its affiliates, officers, employees, and agents against claims, losses, and reasonable legal costs arising from your use of the Service or from a breach of these Terms, applicable law, or third-party rights.
14. Termination, changes, and general terms
You may stop using the Service and request deletion at any time. If you engage in fraud, breach these Terms or the law, or harm the Service, we may, after notice where appropriate, suspend or terminate your account, remove content, or refuse service. After termination your license ends. Provisions that by nature should survive do survive. We may update these Terms at https://ximo.tv/terms and will give reasonable advance notice of significant changes in the product or by email. Unless you tell us before the effective date that you object, you are treated as accepting the changes. If you object, stop using the Website after the changes take effect. Either party may then terminate immediately. These Terms are the entire agreement. If a provision is invalid, the rest remains in force, and a provision that can be read down will be read down. A delay in enforcing a right is not a waiver. A waiver must be in a writing signed by us. We may assign our rights. You may not assign yours. These Terms do not create an agency, partnership, joint venture, or employment relationship. Notices may be given by email or by posting on the Website and satisfy any requirement that they be in writing.
15. Law and contact
These Terms, your use of the Website, and the relationship between you and us are governed by the laws of the Republic of Cyprus, excluding its conflict-of-law rules. Legal proceedings relating to the Website, these Terms, or their performance shall be brought in a competent court in the Republic of Cyprus. The parties consent to the exclusive jurisdiction of that court and will impose the same obligation on their affiliates. You consent to service of process in those proceedings.
